working time!<\/p>\n<p><strong>Applicable rules:<\/strong><\/p>\n<p>The article <a class=\"\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020517\" target=\"_blank\" rel=\"noopener\">L 3121-1<\/a> of Labor Code defines effective working time as the time during which the employee:<\/p>\n<ul>\n<li>is available to the employer and<\/li>\n<li>complies with his directives without being able to freely carry out personal activities<\/li>\n<\/ul>\n    <\/div>\n<\/div>\n<!-- \/module text -->        <\/div>\n                        <\/div>\n        <\/div>\n professional travel time to get to one&#8217;s place of work is not considered as actual working time, but that if the duration of this journey is abnormally long, the employee may claim rest or financial compensation.<\/p>    <\/div>\n<\/div>\n<!-- \/module text -->        <\/div>\n                        <\/div>\n        <\/div>\n                        <div  data-lazy=\"1\" class=\"module_column tb-column col-full tb_epd4349 first\">\n                    <!-- module text -->\n<div  class=\"module module-text tb_sjw955  repeat \" data-lazy=\"1\">\n        <div data-lazy=\"1\">\n        <div  class=\"tb_text_wrap\">\n        <p>The Court of Justice of the European Union (CJEU) considers that, when workers do not have a fixed or usual place of work, the travel time of these workers between their home and the sites of the first and last clients designated by the employer constitutes working time.<\/p>\n<p><span style=\"font-size: 18px; text-decoration: underline;\"><strong>Reversal of case law<\/strong><\/span><\/p>\n<p>In a judgment of March 1, 2023, concerning a maintenance technician, the social chamber of the Court of Cassation establishes the principle that travel time between home and work may have to be paid if it meets the definition of actual working time.<\/p>\n    <\/div>\n<\/div>\n<!-- \/module text -->
